  1. Scope of application

The following terms and conditions are an integral part of all contracts entered into between us

  1. Application use and transportation services as two performance subjects

  2. Use of the Application and the Service
    1. Taxicol makes the Application available to the Customer for free use subject to the terms of the License.
    2. By using the Application and the Service, the Customer enters into a platform usage contract with Taxicol. The use of the platform is free for the customer.
    3. The platform usage contract with Taxicol also comes into force if the Customer uses the Service indirectly via an intermediary platform application and the Service is only available to a limited extent to customers using the Service via an intermediary platform.
    4. In order to conclude a contract to use the platform, the customer must have reached the age and full legal capacity according to the law governing civil capacity in the country in which the application is active.
    5. Customers with limited legal capacity are guaranteed by agreeing to these terms and conditions through his agent, legal guardian, or his legal representative who has agreed to conclude the contract after writing the information of those with limited capacity, as well as their representative in the application before performing the service

    9. If the customer retains a taxi car for a third party (passenger), the customer must inform the passenger of the correctness of the terms and conditions of carriage below.

If the agent, legal representative or legal guardian books a ride for the person represented because the latter is not legally qualified, the legal representative, representative or legal agent must also conclude the contract of carriage with the provider on behalf of the person represented at the beginning of the trip (contract in favor of the three parties).

    17. The customer is obligated to maintain the security of his username and password.   3. Transfer booking
    1. In order to book a transportation service, the customer first sends: a ride request through the application and provides the basic data necessary for the requested transportation service. The Taxicol booking system (automatic application) analyzes the feasibility of the request taking into account the concept and notifies the customer whether the requested transportation service can be carried out.
    2. If the customer wishes to transport baggage that exceeds the usual size of hand baggage, an additional space must be reserved for that by clicking in the space designated for that in the application, and the provider reserves the right to refuse to transport customers in the event of non-compliance with this.
    3. .Wheelchairs or other walking aids are not considered baggage for the purposes of this rule. Wheelchairs and walking aids are always transported free of charge, without reserving an extra seat and provided that the luggage compartment capacity allows it.

    5. Both the provider and the customer have the right to cancel the reservation until the conclusion of the contract of carriage. However, Taxicol at its sole discretion will charge a cancellation fee.
  4. Availability and changes
    1. The Customer has no right to demand the continuous and uninterrupted availability of the Application and the Services or to complete the transmission of information in a timely manner. Taxicol reserves the right to change the Application in a manner reasonable to the Customer at its sole discretion, in particular to further develop and improve the Application and the Service and to correct errors.
    2. Taxicool also has the right to stop providing the application or the service at any time, even without notifying the customer individually.
    3. The Provider reserves the right to change these services at its sole discretion or to discontinue the service altogether.
  5. Usage rights and obligations
    1. Subject to the following limitations and conditions, Taxicol grants Customer a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to own install and use the Application on Customer's mobile device as well as to use all content, information and related materials made available via the Application.
    2. Taxicol does not grant the Customer any rights in the Application other than as provided in (1) of these Terms and Conditions. The customer has no right to copy, distribute, exploit the application in a profitable way, or make changes to the application, and the customer has no right to examine the performance of the application, disassemble it into its components, rebuild it, or use its code or other components to create its own programs.
    3. The Customer shall use the Application in a manner that does not affect the operation or functionality of the Application. Customer shall not attempt to gain unauthorized access to or impair any part of the Application and its connected systems or networks.
    4. The Customer is not allowed to remove references to the copyrights, trademarks or other proprietary rights of TaxiKul from the relevant part of the Application.

  3. Non-fulfillment of the reservation

  4. General terms and conditions for using the transportation service
